
Terms and Service
By entering, You agree to adhere the following terms, failure to do so will result in cancellation of your order and black list from future commissions. TOS my be edited or added at my discretion if I feel the need to when required. Outstanding customers will be notified of any changes should this occur during their commission process.
I have the right to reject any order that I do not feel comfortable drawing for any reason.
PAYMENT:

Payment via PayPal only. Payment is required within 48 hours of ordering to confirm your slot, unless an alternate payment deadline has been agreed. After this time slots will re-open to other customers in the queue. (Payment via cryptocurrency on PayPal is not accepted).

You must be the legal owner of the PayPal account in question, by making payment you agree that you are over 18 years of age and the rightful owner of the account.

Quoted timeframes for completion are effective from time of full payment, not the time of ordering. No work will be undertaken until full payment is received.

Delays to payment or failure to pay with no communication will result in your commission being cancelled.

Repeat offences will impact the likelihood of you being accepted for slots in the future and may result in a blacklist.

I will not accept NFT sales or transactions involving Cryptocurrency are also not permitted.
REFUNDS:

Full refunds options are available at client's request up to the Sketch stage of a commission. After which, full/partial refunds will be offered only at the artists discretion dependent on time of cancellation. Refunds are not available once a piece is completed and approved by a client.

If for any reason I am unable to start your commission you will receive a full refund.

I hold the right to cancel commissions at any stage of the work. A full refund will be given as well as the work at its current state, with no additional charges. Any additional compensation will only be given at the artist's discretion and is not required.
If the buyer breaks any of the points stated above they will lose all the beforementioned rights to the artwork commissioned by me, Jacy Frett (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.
PIPELINE AND TURNAROUND TIME:

I require information based on your request before any transaction or work begins. Information about the commission is essential and may include:

Character details. e.g. race, gender, height, build, hair colour, etc.

Clothing instructions- What the clothing looks like and how it fits on the character.

References. This can be from real life or already existing characters

Pose instructions and placement. (How the character placed in the scene)

Lighting instructions- Is there a backlight? Where is the light source coming from?
You do not need to provide all these examples, but the more information I have the better.

Please allow at least 1 month for all commissions to be completed. Average turnaround is 1 week depending on the size of the order. You will receive an ETA upon ordering, but note this is an estimation and all commissions may take up to 2 month as standard.

I may send small thumbnails and rough sketches to make sure that the client is happy with the direction the commission is taking. This will not be included in the sketch stage of the commission and will not require payment at that time.

Please bare in mind I am working on multiple commissions, and turnaround may be effected due to the number of commissions.

There is no order or priority list. I will work on the commission that I can reasonable complete first. This may be due to a client not replying to an update in their commission, in which case I will move on to the next commission until more information is offered.

Any delays or errors in the production will be reported to the client. I will always strive to give accurate timeframes and updates regarding any delays in your commission.

If there is a deadline to your commission, you must make me aware of this at the point of ordering and a rush fee of up to 50% may be applied at artist's discretion.

Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product.
REVISIONS:

You get 2 rounds of changes on the commissioned piece included in the price.

A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.

If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

If your reference is unclear to start with changes will come at an extra charge.

During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.
RIGHTS AND OWNERSHIP:

I might record the drawing process and post it on my YouTube.

All drawings may or will include a subtle sign that you may not remove.

I hold the rights to any commission I create. This includes the right to showcase the commission on portfolio websites and social media platforms. (If you would prefer me not to showcase your commission, please contact me beforehand)

(Whilst you may own the characters featured, I still retain legal rights to the art piece itself so please respect this and credit if sharing publicly.)

Prices provided are for personal commissions only, please contact me to inquire about commercial or business orders. This includes any situation where my art will be used for profit, advertising & marketing or feature on profitable streaming services such as Twitch and YouTube.

If you are using the commission for commercial use, additional charges may apply.

Any purchase of the rights to your commission will be discussed before the commission starts.

The customer may display or print their art for personal use only. Commercial printing for profit is not permitted unless discussed and agreed upon by the artist.

If you request art of someone else's character, or a character you do not own then permission/consent from the owner must be provided. You will not receive the requested art if I discover the character is stolen or has been drawn without the owner's permission. In this circumstance, I reserve the right to keep a service charge of up to 50% of the total commission value before any refunds occur to cover my time and expenses.

Do not remove the artist signature from the work. Failure to adhere to this term may result in the client being blacklisted from this service. Cropping images for icons / personal use is permitted.

Credit must be given when my artwork is displayed in public areas such as public social media channels, YouTube videos and art hosting websites like DeviantArt and Instagram. Failure to credit may result in a copyright claims for removal.

Credit and referencing requires you to state the artist name "Jacy Frett" somewhere on the page, such as the title or description.

I hold the right to blacklist customers or potential clients who show argumentative, abusive or offensive behaviour towards myself (the artist), another client or other individuals. Instances of (but not limited to) racism, sexism, homophobia and transphobia may also result in a blacklist even if not directed at the artist.
RESTRICTIONS:
I will not draw:

Explicit imagery. E.g. Sex scenes, genitalia.

I will accept artistic NSFW references (i.e. naked ref sheets featuring breasts or genitalia) where no others are available however please provide a comment or tag to inform me before sending NSFW references.

Real photos of yourself or other individuals in a NSFW or sexual context will not be accepted and will result in a blacklist. You may be reported to the authorities in extreme cases.
-Other people's personal characters you do not hold permissions for.
-Offensive content - I will not create emojis based on offensive memes & other content which hold alt right, racist, sexist, homophobic, transphobic or other offensive tones.
Case by Case Basis:
(The following themes and depictions will be subject to review and further discussion before beginning the commission. I hold the right to reject the commission if I feel it does not meet my restrictions.)

Guns: I will not draw armed civilians or police in scenes which glorify or promote pro-gun law ideologies.

Explicit language: I may refuse to feature certain terminology in my works if I am uncomfortable with this or believe it allows my work to be used in an offensive manner.
-Bodily harm/ disfiguration: Scenes that feature bodily harm or disfiguration will not be allowed if they are graphic and meant to invoke discomfort and terror. E.g. monster transformations, gore, result of illness.
